    1. Our contract

    1.a. All bookings are made with Via Turizm ve Fotografcilik Ltd Sti. trading as Freesia Travel (hereafter referred to as Freesia Travel, us or we).
    1.b. By booking a product with us you will be deemed to have read, understood and accepted these Booking Terms & Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation / invoice.
    1.c. A `Client` (You) is all persons named on the booking form intending to travel with Freesia Travel.
    1.d. A `Product` is any service sold by Freesia Travel.
    1.e. A contract between you and us comes into existence when we have confirmed the booking in writing and issued a Confirmation.
    1.f. The person submitting the booking form (that incorporates these terms and conditions), either in hard copy or online warrants that s/he has full authority to do so on behalf of all persons whose names appear thereon, and confirms that all such persons are fully aware of and understand these terms and conditions.
    1.g. We reserve the right to decline any booking at our discretion without further explanation.

    2. Deposit & Final Payment

    2.a. Package Tours : We require min 30% deposit payment for an exact confirmation of your bookings. Final payment is due 27 days prior to departure. If your booking is made within 27 days of the departure date, then the full amount is payable at the time of booking.
    2.b. Daily Tours : The full amount is payable at the time of booking.
    2.c. Shore Excursions : The full amount is payable at the time of booking.
    2.d. Hot Air Balloon Tours : The full amount is payable at the time of booking.
    2.e. Airport Transfers : The full amount is payable at the time of booking.

    3. Amendments & Cancellations by You

    You can cancel at any time, however cancellation fees apply. The cancellation will be effective as at the time that we receive a written request from you or your Agent. The following cancellation charges will apply:

    3.a. Travel Packages ;
    3.a.a. If you cancel at least 7 day(s) in advance of the scheduled departure, there is no cancellation fee.
    3.a.b. If you cancel between 3 and 6 day(s) in advance of the scheduled departure, there is a 50 percent cancellation fee.
    3.a.b. If you cancel within 2 day(s) of the scheduled departure, there is a 100 percent cancellation fee.
    3.b. Daily Tours, Shore Excursions, Hot Air Balloon Tours, Paragliding, ATV Safari, Horse Safari ;
    3.b.a. If you cancel at least 3 day(s) in advance of the scheduled departure, there is no cancellation fee.
    3.b.b. If you cancel within 2 day(s) of the scheduled departure, there is a 100 percent cancellation fee.
    3.c. After your booking has been confirmed proposed amendments must be provided to us in writing by `the Lead Client` and will incur an administration fee of equivalent to EUR 50.00 except for the first change that will incur no fee or as otherwise agreed. No requested change can be guaranteed.
    3.d. If any number of your party is prevented from travelling because of death, injury or serious illness of the client, close relative or friend, redundancy or jury service, it may be possible to transfer the booking to another suitable person or departure date or tour of similar standard and cost provided that written notice is confirmed by Freesia Travel.
    3.e. If a refund is payable to you either because of an amendment or cancellation, the refund amount will be calculated according to these conditions and with consideration of evidence of exceptional circumstances. All bank fees incurred for processing/transferring the credited amount to the client will be the responsibility of the client.
    3.f. No refund is given for a partially used Product.
    3.g. No refund is available on bookings that received a discount due to a special offer or promotion.

    4. Cancellation By Freesia Travel

    4.a. We reserve the right to cancel any confirmed booking in any circumstances, however, we will not cancel a Guaranteed Departure Product except in the unusual circumstances of force majeure, defined here as war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, flight cancellation or any other external circumstances beyond our control. Compensation is not available if we are forced to cancel or in any way change a tour due to force majeure. However, where we are unable to provide the tour booked, we will return to you any monies paid to us (less any insurance premiums paid) or offer an alternative date or holiday of comparable standard.

    5. Information and Pricing Policy

    5.a. Before a booking is confirmed, we reserve the right to amend brochure prices due to any circumstances outside our control, such as but not limited to changes relating to governmental action, increases in transportation costs (including schedule airfares and the cost of fuel) changes in any dues, taxes or fees chargeable for services (including landing taxes or embarkation/disembarkation fees at airports), increases in admission fees and exchange rates.
    5.b. Bank transfers are accepted as the full amount payable as published. We can only accept credit card payments in Turkish Lira (TRY). The full amount payable in Turkish Lira is calculated by taking the daily buying exchange rate on the date of sale multiplied by the full amount published and payable. The daily exchange rate can be found at www.tcmb.gov.tr. Your bank will use their exchange rate when charging your credit card for the amount of Turkish Lira that was withdrawn by us. We accept no responsibility for variations in the final transaction amount due to foreign currency and other fees and exchange rates used by banking institutions.
    5.c. Any reduced prices or discounts that become available after you have paid your deposit will not apply to you. If you wish to cancel your booking to take advantage of a cheaper price, normal cancellation conditions will apply.

    6. Accommodations

    6.a. Organised tour accommodations are based on twin/double/triple share accommodation.
    6.b. For pre and post tour accommodations the entire room will be reserved for you. We cannot arrange shared pre and post tour accommodations for single travellers. Payment of a single supplement is required in this instance.We will make every effort to accommodate people travelling together in their requested room type, however, this cannot be guaranteed.
    6.c. Special requests such as bed types, smoking preference and connecting rooms are subject to availability.
    6.d. If you are booking a triple room, please note that in some hotels, the third bed may be a “fold-away” bed. Availability of triple rooms is limited. We are not liable if a hotel can only provide a fold-away bed, and no compensation is payable to you in any such instance.
    6.e. Single rooms may be smaller than a twin-bedded or double room.
    6.f. The advertised hotels are intended to give an idea of the type of accommodation that may be expected. The actual hotels used for any given tour may change due to many reasons such as group size, availability, time of year, hotel standard has dropped or simply we found a better hotel. We update you by email immediately if and when any changes take place. If and when we do change hotels it will be to a hotel of equal or higher standard and will be at no extra cost.

    7. Travel Insurance

    7.a. Under Turkish Law, adequate insurance is mandatory for all Clients to cover at least but not limited to personal accident, death, medical and repatriation expenses, loss of luggage and cancellation or curtailment of a Product and should not exclude any planned adventure activities from the time of booking for the full duration of the Product as a minimum. A Client and their personal belongings are the sole responsibility of the Client. Freesia Travel accepts no liability on the Client`s behalf where Freesia Travel has provided a Product of reasonable standard. You are fully responsible for arranging your own insurance. You will be asked to provide proof of your travel insurance on Day 1 of your tour. You will not be able to join the tour without it.

    8. Liability of Freesia Travel

    8.a. Freesia Travel Products and in particular, adventure activities, contain an element of risk to the personal safety of the Client that other package holidays may not contain. By accepting these Booking Conditions you are aware of the risks inherent in their chosen travel and you undertake such risks at your own volition. We accept no liability of Client`s damages where we have fulfilled our Duty of Care to Clients by providing Products of a reasonable standard. We accept no liability if there has been no fault on the part of Freesia Travel or its` suppliers, and the reason for the claimed damages was either the Client`s fault or a result of unusual circumstances beyond the control of Freesia Travel by force majeure or otherwise and the consequences of which could not have been avoided even with all due care.
    8.b. In respect of carriage by air, sea and rail and the provision of accommodation, our liability in such cases will be limited in the manner provided by the relevant international conventions.
    8.c. We accept no liability if you incur additional costs through delay, accident or disruption of the Product(s) beyond our control by force majeure or otherwise.
    8.d. Optional activities not included in the tour price are not part of the tour or this contract. Although your tour guide may assist you to arrange optional activities this does not imply liability on our part. The contract for the provision of that activity will be between you and the optional activity provider.
    8.e. Where you occupy a seat in a vehicle fitted with a seat belt, neither Freesia Travel nor our agents or contracted service providers will be liable for any injury, illness or death or for any loss or damages or claims arising from any accident or incident if the seat belt is not being worn at the time of such accident or incident.

    9. Travel Documentation

    9.a. It is your responsibility to be in possession of a valid passport, visa permits, vaccinations, preventative medicines and other medical certificates and all necessary travel documents.
    9.b. We are not liable for damages arising from changes in regulations or laws to the necessary travel document requirements. We provide information about these matters in good faith, however without liability.
    9.c. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other documentation.
    9.d. In the case of lost or stolen documents, while we are happy to assist in any way possible, we cannot be held responsible for any additional costs and you are not entitled to any reimbursement or compensation of paid travel expenses.

    10. Health, Safety and Conduct

    10.a. Prior to booking, all Clients are expected to satisfy themselves that they are fit and able to complete the itinerary of their chosen tour as described in the brochure. If you have any pre-existing medical conditions or illness you must declare the true nature of such conditions at the time of booking, and make arrangements for the provision of any medication or other treatment which may be required during the tour. Such a client is required to provide a medical statement from a General Practitioner to confirm they are fit to travel. Failure to make any such disclosure will constitute a breach of these booking conditions and relieve Freesia Travel from any obligations and liability. While we are happy to take special meal requests, we cannot be held responsible if they are not provided at hotels or restaurants during the tour. It is your responsibility to have any inoculations that may be required for your intended destinations. You must advise Freesia Travel of any allergies or other physical conditions which might affect you during the tour. We reserve the right to decline or accept any person as a member of the tour or to decline or retain any person if such person`s physical condition, mental well-being or behaviour interferes with the operation of the tour. There will be no refund in such cases.

    11. Client Exclusion and Local Law

    11.a. You agree to accept the authority and decisions of Freesia Travel`s employees and its supplier`s employees and representatives whilst on tour. If in the opinion of such persons, your health or conduct before or after the departure appears likely to endanger the safe, comfortable or happy progress of the tour, you may be excluded from all or part of the tour without prior notice or any liability on the part of Freesia Travel. In the case of Client ill health, we may make such arrangements as it sees fit and recover the costs thereof from the Client. Passengers agree to comply with the laws and regulations of the countries they travel. We will not be liable to any Clients who commit illegal or unlawful acts whilst on tour.

    12. Photography and Marketing

    12.a. Our authorised representatives may take photographs and films of you while using any Freesia Travel Product. We reserve the right to use said material for any advertising or promotion in any medium we choose without obtaining further consent. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes. We also reserve the right to use any comments you make, questionnaires or complimentary letters with respect to us, or our Products, minus any identifying information, in promotional literature without obtaining further consent.

    13. Complaints

    13.a. If you have a complaint about any of the Product arrangements you must raise the complaint immediately with a Freesia Travel employee so that we can use our best endeavours to rectify the problem. We cannot rectify a problem we are unaware of. Failure by you to complain on the spot will extinguish or at least reduce our liability to pay compensation. Should we be unable to resolve the problem on the spot, a complaint must be made in writing within 30 days of completion of the product.

    14. Personal Data

    14.a. All Client data is protected in accordance with "Protection of personal data" laws. By making a booking with us, you agree to our use of this data in order to meet contractual and other tour operations obligations. We reserve the right to use this for direct marketing purposes, market research, customer demographics, statistics and information of Freesia Travel and its business partners. If you do not want your data to be used by us, you may advise us by email, and said data will be destroyed.

    15. Tour Inclusions and Exclusions

    15.a. The price of your tour includes all accommodation, transport and sightseeing as listed in the inclusions section of your itinerary. Your tour price excludes any item not mentioned in the inclusions section of your itinerary. This includes, but is not limited to: air travel unless mentioned within the inclusions of the tour; airport arrival/departure taxes, visas, personal insurance, personal items such as, but not limited to, extra beverages at meals, food or snacks at times other than your meal included on the itinerary, laundry, telephone, fax or Internet/E-mail access charges, film, fees for taking photographs or videos in certain locations, fees for changing money, medical expenses, excess baggage fees, customs duties, shopping and tips or gratuities. In short if it`s not mentioned in the inclusions section of the itinerary then its not included.

    16. Airport Transfers

    16.a. Airport transfers, where included in the tour, are available upon the start of services, for inbound transfers and the final day of tour for outbound transfers as per the tour itinerary. If you book pre-tour accommodation through us, the check in date would be deemed as the start of your services with us.
    16.b. Istanbul airport transfers where included in the tour are available for all flights from either Istanbul or Sabiha Gokcen airports.
    16.c. Full flight details including arrival time and flight number must be provided a minimum of 48 hours prior to arrival. Failure to provide full and correct details may void transfer entitlement.
    16.d. Airport transfers are only available to and from tour hotels as specified by Freesia Travel.

    17. Luggage

    17.a. In addition to any personal items such as a handbag or laptop computer, you are entitled to have one main piece of luggage and a cabin bag or day pack. Please note that some domestic airlines in Turkey have a luggage limit of 15kg. If your tour program includes a domestic flight and your luggage exceeds 15kg you will be responsible for any excess baggage fees.

    18. Updates to Terms and Conditions

    18.a. Freesia Travel reserves the right to update and / or alter these terms and conditions at any time, and it is the Clients` responsibility to be familiar with them. The latest terms and conditions can always be found on the Freesia Travel website: www.viatourism.com.tr and will supersede any previous versions.

    19. General

    19.a. No employees or representatives of Freesia Travel have any right to alter, vary or waive any of these terms and conditions, nor to undertake any liability whatsoever on behalf of Freesia Travel, unless such be in writing and signed by the Managing Director of Freesia Travel.
    19.b. All contracts for bookings made with Freesia Travel are governed by Turkish law and are subject to the exclusive jurisdiction of the Turkish courts should any dispute arise between parties to this contract.

    20. Iyico Privacy Policy

    20.a The Customer (end-user) agrees to the transferral of their data related to the payment methods, membership and orders to iyzico Ödeme Hizmetleri A.Ş. (“iyzico”) and agrees to the processing and storage of these data by iyzico in order to finalize the payment transactions and to enable prevention, investigation and detection of fraudulent transactions as described in the most current version of the Privacy Policy at https://www.iyzico.com/en/privacy-policy/


    1. Overview
      This Privacy & Personal Data Policy is meant to provide information on the personal data collected, retained, processed, shared and transferred by Via Turizm ve Fotografcilik San. Ve Tic Ltd. Sti.. Any person who visits Via Tourism website, or uses any service provided by Via Tourism (e.g. makes a payment with his/her credit card to a merchant that receives payments via Via Tourism) is covered by this Privacy & Personal Data Policy
      When the term " Via Tourism " is used, it covers both Via Turizm ve Fotografcilik San. Ve Tic Ltd. Sti. and Freesia Travel as they share the same privacy principles and policy. Via Tourism might be referred to as "we", "us" or "our" in this policy. Legal titles and contact information of Via Tourism companies can be found at the end of this document.
      The terms "personal data", "personal information" and "your information" are used interchangeably and they mean any information than can be associated to an identified or identifiable natural person (e.g. name, e-mail address, birth date, national ID number)
      We are aware that personal data is important for our clients as well as end users and we endeavor to undertake all necessary measures to ensure this policy is complied with by everyone within Via Tourism and that your personal data is kept safe.
      Purpose of this Privacy & Personal Data Policy is:
      • To explain, in the most transparent and readable way possible, our ways and purposes of using the data we collect about you;
      • To clarify the types of information we collect upon your permission and the purposes and methods for processing of them;
      • To inform you on the third parties we transfer this information to as well as our purpose and method in doing so;
      • To let you know your choices and legal rights with respect to your personal data;
      • To describe the extent of our responsibility for protection of your rights and privacy.
      This policy applies to products and services of Via Tourism only. On websites and mediums that do not belong to Via Tourism, the policies and rules of the respective person or organization.
      The type of personal data processed by Via Tourism depends on which services you benefit (some of them may not be available according to your region and legal status) and how you benefit from them.

    2. Personal Data Collected by Via Tourism
      We collect different types of personal data about you when you visit our website or use our services.
      When you visit our website, send a payment via viatourism.com.tr, we will collect information necessary to offer and fulfill your request in an efficient and secure way. This information may include:
      • Your contact details (e.g. your name, address, e-mail address, ID number).
      • Payment details (e.g. your credit card number, expiry date, instalment choice).
      • When someone sends funds to, or enters into any transaction that requires them to provide personal information about third persons, we collect personal data about those third persons.
      • If you are a seller utilizing a platform (e.g. a marketplace) which uses our services, the platform may transfer your personal data such as contact details and bank account number.
      • Additional details you provide to us when you make use of services provided by Via Tourism or when you contact Via Tourism (e.g. via the contact us form located on our website or e-mail).

      3. Use of Personal Data by Via Tourism and Legal Basis for Processing
      We use your personal data for various purposes permitted under data protection laws in Turkey and the European Union. Our purposes in using your personal data are explained with some examples below and are justified by lawfulness criteria stipulated in data protection regulations of the European Union and Turkey, such as performance of contractual obligations, our legitimate interests, and legal obligations.

      • To improve our services and manage our business needs,
      We monitor usage of our sites and services by you and analyze usage data to enhance our performance.
      • To mitigate and manage risk and protect our platform and customers from harm,
      We detect and prevent fraud by identifying customers and measuring their risk level. These decisions may be made by automatic algorithms as well as human effort under set rules. If you learn that a transaction you want to make has been rejected as a result of those procedures, you may contact us at the contact information provided at the end of this document.
      • To contact you when needed,
      We may contact you regarding the status of your transaction. Also, when there is an issue related to your account or a payment you make, we may use your personal information to reach out to you so that we can resolve the issue. You may be contacted by Via Tourism employees, or by employees of our business partners, in which case we need to share your personal data with those business partners.
      • To meet our legal obligations or resolve disputes,
      Some regulations in the jurisdictions require us to use and retain your information in certain ways. As a travel services provider, we are obliged to keep and inspect records of all transactions we facilitate for various reasons including data retention, anti-money laundering and taxation.
      When there is a legal dispute between Via Tourism and you, or between parties of a transaction facilitated by Via Tourism, your information may be used to resolve the dispute and presented to courts and other authorized dispute resolution authorities.
      We may also use your information in additional ways that you have consented to. For instance, we may seek your consent for sending you marketing material, receiving your feedback or other processing activities. In those cases, you can always withdraw your consent by contacting us at the addresses provided at the end of this Policy. You should include information that enable us to recognize you in that notification. Your notification of withdrawal of your consent will be effective in the future and therefore will not make our prior processing unlawful but it will make us cease to process that information from the receipt of your notification onwards.

      4. Retainment and Erasure of Personal Data
      Via Tourism retains your personal data in an identifiable format for the shortest period of time necessary to fulfil our legal obligations and for our business needs.
      When the period during which we retain your personal data ends, we will erase or anonymize your personal data so that they can no longer be associated with you, in line with our internal procedures that aim to ensure safety of your personal data.
      When you cancel your reservations or request erasure of your personal data, we will erase or anonymize parts of it that we are not legally obliged to reject your erasure request or to keep even if your reservation is cancelled.

      5. Transfer of Personal Data to Third Parties
      While providing our services, we sometimes share your personal information with third persons for purposes explained in this section.
      We share your personal data within the Via Tourism group companies – cooperate partners (eg. airlines, hotels, transportation companies, insurance companies, etc.) in order to manage our operations and provide our services in a safe and consistent manner. The transfer between Via Tourism and partners takes place with adequate safeguards in place, and your personal data does not fall outside the scope of this privacy policy because of this transfer. We utilize services of other companies as necessary and we may need to share your personal data with some of them. For example, when we receive your payment details we need to transfer them to respective financial institutions to initiate the payment. Or when the transaction you have made requires some additional steps to be taken (e.g. if it is an international purchase and customs procedures are to be completed) we may share your personal data with relevant service providers (e.g. customs brokers). We may also transfer personal data to third persons (e.g. anti-fraud processing companies) in order to ensure safety and convenience of our users and business. When you use our services, we notify the other parties to the transaction you have made, such as other users and merchants and this might include transfer of a portion of your personal data. Law enforcement agents and other authorities may request information from us. We will share your information only when there is a legal obligation to do so; or when it is deemed necessary to prevent and/or prosecute a crime. We may also need to share personal data with third parties for other business purposes (e.g. for audits, corporate governance, or executing our legal rights). We will always comply with the law when doing so.
    3. Choices Available to You
      You have choices available with respect to our privacy practices. You may always decline to provide personal data requested by Via Tourism. However, if the information you have declined to provide is mandatory for provision of our services, you may not use our services. For instance, if you decline to enter your credit card number on the checkout form, we cannot initiate the payment. From time to time, we communicate with you. These communications may be for marketing purposes or notifications related to a transaction you have been a party to. You can opt-out of all marketing related communications by following the instructions at the end of messages we send. However, you cannot opt-out of transactional messages.
    4. Your Rights
      We want you to know that you have following rights with respect to your personal data, as per the regulations governing use of personal data within EEA or Turkey:
      (a) To learn if we process your personal data, the types of data we process, sources we get your personal data from, third parties we transfer your personal data to within the country or internationally, the period for which we keep the personal data or how we determine that period;
      (b) To access your personal data and to request the data provided by you to be given to you or another data controller in a structured, commonly used and machine readable format,
      (c) To learn the purposes for which your personal data is processed and to query if they are used in a compatible manner with those purposes,
      (d) To object to and request restriction of processing of your personal data,
      (e) To request rectification of inaccurate and incomplete personal data about you,
      (f) To request erasure of your personal data when there is no legal basis for further processing,
      (g) To request notification of procedures such as erasure and rectification to other third parties to whom your personal data has been transferred,
      (h) To object to any negative consequences arising from automatic analysis of your personal data,
      (i) To request indemnification for any damages arising from unlawful processing of your personal data.
      You can exercise these rights by contacting us at the addresses provided at the end of this Policy. Your application should include the information you have given to us while registering or making use of our services as well as a photo ID, so that we may identify you.

      8. Protection of Personal Data
      All personal data collected by Via Tourism is transmitted and stored in compliance with reasonable security standards as adopted by the industry. The security of payment data is ensured with our PCI DSS Level 1 Compliant infrastructure and all connections where personal data is transmitted are protected with encryption. Even though we take all reasonable measures to protect your information, you are responsible for securing and maintaining your account information.
    5. Miscellaneous
      Our services and websites are not directed to children, i.e. people who are not legal adults. We do not collect personal data from children or other individuals who are not legally able to use our services. If we find out that we have collected Personal Data from a child, we will promptly delete it, unless we are legally obligated to retain such data. If you believe that we have mistakenly or unintentionally collected information from a child, please contact us immediately at the addresses below.

      We may make changes to this privacy policy in the future. Changes to the privacy policy will become effective on the date it is published to be effective. Via Tourism obliged to follow any possible updates and inform their customers (or other users they make transactions with) on fintech company`s data-processing activities (as well as this privacy policy) before they transfer other persons` information to fintech company.
